Buying or Selling a Property with a Septic System? Here’s What You Need to Know

 

If you're dealing with a property that has a septic system in Colorado, it's important to understand the regulations that could impact your transaction. Since the adoption of Regulation #43 in June 2013, many counties across the state have implemented specific rules around septic system permitting and inspections.

One key regulation to be aware of is the transfer-of-title inspection requirement. As of January 2017, the following Colorado counties require a septic system inspection whenever a property changes ownership:

  • Adams County

  • Arapahoe County

  • Boulder County

  • Clear Creek County

  • Douglas County

  • El Paso County

  • Elbert County

  • Gilpin County

  • Jefferson County

  • Park County

  • Pitkin County

  • Summit County

If you're buying or selling in any of these areas, this inspection must be completed as part of the title transfer process.
